Mediation in Consumer Disputes
As of July 30, 2020 consumer disputes are subject to mandatory mediation process. According to Article 73/A of Consumer Protection Law before filing a lawsuit related to consumer disputes over 10.390 Turkish Liras and the disputes which cannot be determined with money before consumer courts mediation process is mandatory.
Which commercial disputes are exempted from the mandatory mediation is laid down in the Article 73/A. Accordingly
a) Disputes within the scope of the duty of the consumer arbitration committee
b) Objections to the decisions of consumer arbitration committee
c) lawsuits regarding the request for an interim injunction or for the detection, prevention or suspension of the unlawful situation
ç) Lawsuits regarding the cessation of production or sale and the recall of the goods
d) Disputes arising from the consumer transaction which are related to right in rem on real estate property.
