Mediation in Labor Disputes

Under Turkish law as of 01.01.2018 it is mandatory to apply mediation before filing a lawsuit related to the employer or employee’s claims and compansations based on employment contract and reemployment lawsuits before the labor courts.

The applications related to wage, overtime payment, annual paid leave, vacation pay, reemployment indemnity, national holidays pay, indemnity arising from non equal treatment and discrimination, severence pay, notice pay, food and transportation, bonus premium receivables, indemnity based on union rights, wage receivable for balance time are all subject to mandatory mediation process.
